Zen Den Release of Liability Form

1.1. The Massage Chair is a reserved space here at TDD and therefore must be booked using the TDD member’s portal or TDD app. Any use of the chair without being booked will result in a $10 charge to the member’s account.

1.2. Each member will receive (2) Two complementary 30-minute sessions per month as part of their membership. Member will be charged $10 per 30-minute session after the initial 2 uses per month with the charges being applied to the Member’s next month’s invoice. Unused sessions cannot be rolled over into the next month.

1.3. The Member will remove their shoes when using the Massage Chair.

1.4. The Member will wipe down the chair before and after each use with the provided sanitized towels.

1.5. The Member agrees to use the Massage Chair Monday through Friday between 5 am and 6 pm only and agrees to immediately vacate if asked to do so by TDD staff or any affiliate staff.

1.6. The Member understands that the Massage Chair is only for the use of authorized TDD Members and staff. Children, Visitors/Guests, temporary employees, family members or friends of the Member are not permitted to use the massage chair at any time.

1.7. The Member will immediately report any accident, injury, or damage to the massage chair to TDD Staff.

In exchange for the authorized use of TDD’s Massage Chair, the Member does hereby release and hold harmless TDD, and its affiliated or related companies, officers, directors, employees, agents, landlords and lessees (hereinafter “the Released Parties”) from any and all liability for injury their person is caused in any manner, including the negligence of the Released Parties, by use of TDD’s Massage Chair. The Member intends this release to apply to all future use of the Massage Chair. The Member agrees to indemnify and defend TDD against all claims, causes of action, damages, judgments, costs, or expenses, including attorneys’ fees and other litigation costs, which may in any way arise from their unlawful or tortious conduct in connection with their use of the Massage Chair. The Member agrees to pay for all damages to the facilities of TDD caused by their negligent, reckless, or willful actions. The Member acknowledges that TDD’s Massage Chair is designed for the authorized use on a voluntary basis, and that the Member’s use of the Massage Chair is at their discretion. The Member acknowledges that they have been advised to consult with their physician with respect to any past or present injury, illnesses, cardiovascular problem, knee problem, or any other physical condition that may affect their ability to use the Massage Chair in a safe manner. The Member acknowledges that they have discussed the appropriateness of using the Massage Chair, in connection with any illness or condition that the Member has or had, with their physician and that they knowingly execute this Release of Liability.
